Throughout the site, as well as in the HostPass app and all the products the company offers (when we refer to the site or the HostPass site, we refer to all the platforms where HostPass offers its services, as well as all the information contained therein), the terms "we," "us," and "our" refer to HostPass. HostPass offers this site, and the user is bound by the acceptance of all the terms, conditions, policies, and notices established here.
By visiting our site and/or purchasing one of our products, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including all additional terms and conditions referenced within these Terms and those policies and conditions available by hyperlink. These Terms of Service apply to all users of HostPass, including, without limitation, users who are browsers, vendors, customers, and/or employees.

These Terms and Conditions have been drafted in accordance with, among other things, applicable regulations on the Internet, electronic commerce and data protection.
You may not use HostPass's products for any illegal or unauthorized purpose, nor may you violate any applicable laws in your use of the Service. You may not transmit any worms, viruses, or other destructive code.
In addition to the foregoing prohibitions, you are prohibited from using the Site or its Content: (a) to solicit others to perform or participate in any unlawful acts; (b) to infringe the intellectual property rights of HostPass or any third party; (c) to harass, abuse, insult, harm, defame, slander, discredit, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (d) to present false or misleading information; (e) to collect or track personal information of others; (f) to spam, phish, pharm, pretext, spider, crawl, or scrape; (g) for any obscene or immoral purpose; or (h) to interfere with or circumvent the security features of the Service.
We reserve the right to suspend your use of the Service or any related website for violating any of the prohibited uses.
Violation or breach of any of these Terms will result in immediate termination of Services and the initiation of necessary legal action and compensation.
HostPass reserves the right to refuse to provide the Services to anyone, for any reason, at any time.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without written permission from HostPass.
The titles and headings used in the text are for convenience only and do not limit these terms and conditions.
HostPass assumes no responsibility if the information available on this website is not accurate, complete, or current. The material on this website is provided for general information only and should not be relied upon as the sole basis for making decisions without first obtaining more accurate, more complete, or more timely information.

There may be information on the HostPass website or in the content of the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, transit times, and availability. HostPass reserves the right to correct any such errors, inaccuracies, or omissions at any time without prior notice.
HostPass is a company that offers its services through a subscription model. The customer pays a regular fee (monthly or annually) and receives services that are provided upon receipt of payment. Once the customer enters their payment details (card number, expiration date, and all other information necessary to process the transaction), they consent to HostPass charging the corresponding fees via the payment method in question.
It is the customer's responsibility to monitor and review their billing cycle and the next debit, so if they no longer wish to use the service, they must cancel the service, otherwise the next debit will be made and no refund will be given, as HostPass's services will remain available to the customer for the remaining subscription period after payment.
However, HostPass reserves the right to make a refund after examining each individual case and taking into account objective and just reasons, such as a deterioration of the service that does not allow cancellation of the subscription or a counterfeit bank card.
You agree to provide current, complete, and accurate account, billing, contact, and other information necessary for the proper functioning of the Services. You agree to update your payment information (card numbers, expiration dates, etc.) so that we can complete your transactions.
We may provide you with access to third-party tools/platforms over which we have no control or influence. You acknowledge and agree that we provide access to such tools 'as is' and 'as available' without any warranties, representations or conditions of any kind and without any endorsement. We accept no liability whatsoever arising from or relating to your use of tools provided by third-party providers. Any use of such optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which such tools are provided.
Certain content, products, and/or services offered by HostPass may contain materials from third parties. This website contains third-party links that may direct you to websites that are not under our control. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant or assume any obligation or liability for third-party materials.
HostPass's processing of personal data is governed by our Privacy Policy. The data entrusted to HostPass will be treated confidentially and incorporated into the corresponding files, managed by Impress Bulgaria LLC (located at Topli Dol 2A Street, Sofia, Bulgaria EID 205349335), after the user has given their express consent.
With this consent, HostPass is authorized to collect guests' data for registration on the designated platforms of the State Security Forces and Corps, thus becoming the data processor, while the user, who owns the accommodation, is the data controller. To formalize this data processing contract, HostPass and the user must sign a data processing contract. Otherwise, the user may exercise the general processing contract by accepting these conditions.
With regard to the previous paragraph, HostPass informs accommodation owners that they must offer guests a privacy policy that explains what data is processed for what purposes and that HostPass is the data processor and they (the accommodation owners) are the data controller.
If HostPass users do not offer a privacy policy to their guests, data processing may be governed by the following general privacy policy.
The processing of users' personal data by HostPass is carried out in accordance with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights, in the framework of the development of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46 / CE, as well as any other provisions aimed at the development of this regulatory framework.
Subject to the limitations set out in these Terms and Conditions and to the extent permitted by law, we will only be liable for direct damages actually suffered, paid or incurred by you as a result of any failure to comply with HostPass's obligations in relation to the services provided by the Company.
However, to the fullest extent permitted by law, neither HostPass nor its directors, employees, representatives, affiliates, dealers, licensees, agents, or anyone else involved in creating, sponsoring, or promoting HostPass and its content shall be liable for (a) any untimely interruptions, errors, or suspensions, (b) the accuracy and reliability of the data, (c) any direct, indirect, incidental, or consequential damages of any kind, including, but not limited to, lost revenue, lost data, replacement costs, or other similar damages, whether based in tort (including negligence), direct liability, or otherwise, arising out of the use of any services or products purchased through the service, or for any other claim related in any way to the use of the service or any product, including, but not limited to, errors or omissions in any content, or any loss or damage of any kind, arising out of the use of the Service or any content (or products) posted, transmitted, or made available through the Service, even if notified of such a possibility. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, HostPass's liability shall be limited to the maximum extent permitted by law.
When using the Platform, it is the User's responsibility to (a) verify the Guest's identification information by any means they deem appropriate and in accordance with applicable regulations, (b) verify the correct transmission of the information, Guest data and registration forms, as well as any other requirements required by applicable legislation, to the relevant authority or administration, (c) comply with the necessary conditions to ensure the correct reading of the scanned Guest ID, (d) and comply with any additional requirements in the Guest Register required by legislation and not included in the services provided by HostPass.
You agree to indemnify, defend, and/or hold harmless HostPass, its subsidiaries, affiliates, partners, employees, directors, agents, contractors, vendors, service providers, and subcontractors from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of the Terms of Use or the terms and policies incorporated herein by reference, or your violation of any law or the rights of a third party.
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be deemed severed from these Terms and such determination shall not affect the validity of any remaining provisions.
These Terms and any other terms, policies or agreements under which HostPass provides its services shall be governed by Spanish law and shall be governed and interpreted according to the order of precedence of the rules established by Spanish law, in accordance with the autonomous regulations of Andalusia and the local regulations of the city of Seville.
